Privacy Policy

This privacy policy informs you about the type, scope and purpose of the processing of personal data (hereinafter referred to as “data”) within our online offering and the associated websites, functions and content, as well as external online presences, such as our social media profiles (hereinafter collectively referred to as “online offering”). With regard to the terminology used, such as “processing” or “controller”, we refer to the definitions in Art. 4 of the General Data Protection Regulation (GDPR).

Types of data processed

– Inventory data (e.g., names, addresses)
– Contact data (e.g., email addresses, phone numbers)
– Content data (e.g., text entries, photographs, videos)
– Usage data (e.g., websites visited, interest in content, access times)
– Meta / communication data (e.g., device information, IP addresses)

Categories of data subjects

Visitors and users of the online offering (hereinafter collectively referred to as “users”).

Purpose of processing

– Provision of the online offering, its functions and content
– Answering contact inquiries and communicating with users
– Security measures
– Reach measurement / marketing

Definitions

“Personal data” means any information relating to an identified or identifiable natural person (“data subject”); a natural person is considered identifiable if they can be identified directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, an online identifier (e.g., cookie) or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

“Processing” means any operation or set of operations performed on personal data, whether or not by automated means. The term is broad and covers virtually any handling of data.

“Controller” means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of processing personal data.

Relevant legal bases

In accordance with Art. 13 GDPR, we inform you of the legal bases of our data processing activities. Where the legal basis is not specifically mentioned in this privacy policy, the following applies:

– Consent: Art. 6(1)(a) and Art. 7 GDPR
– Performance of a contract or pre-contractual measures: Art. 6(1)(b) GDPR
– Compliance with a legal obligation: Art. 6(1)(c) GDPR
– Protection of legitimate interests: Art. 6(1)(f) GDPR
– Protection of vital interests: Art. 6(1)(d) GDPR

Cooperation with processors and third parties

If we disclose, transmit, or otherwise grant access to data to other persons or companies (processors or third parties) in the context of our processing, this is done only on the basis of legal permission, consent, legal obligations or our legitimate interests.

If we commission third parties to process data on the basis of a “processing agreement”, this is done under Art. 28 GDPR.

Transfers to third countries

If we process data in a third country (outside the EU/EEA), or if this occurs through the use of third-party services or disclosure/transfer of data to third parties, this will occur only:

– to fulfil (pre)contractual obligations,
– based on your consent,
– due to a legal obligation, or
– based on our legitimate interests.

Unless otherwise permitted by law, data will only be processed in a third country under the special conditions of Art. 44 ff. GDPR (adequacy decisions, standard contractual clauses, etc.).

Rights of data subjects

You have the right to request:

– confirmation of whether data concerning you is being processed, access to such data and a copy thereof (Art. 15 GDPR)
– completion or correction of inaccurate data (Art. 16 GDPR)
– deletion of your data (Art. 17 GDPR) or restriction of processing (Art. 18 GDPR)
– to receive the data you provided and transfer it to another controller (Art. 20 GDPR)
– to lodge a complaint with a supervisory authority (Art. 77 GDPR)

Right of withdrawal

You may withdraw your consent at any time with future effect (Art. 7(3) GDPR).

Right to object

You may object at any time to the future processing of data concerning you (Art. 21 GDPR), particularly against processing for direct marketing purposes.

Cookies and objection regarding direct marketing

Cookies are small files stored on users’ devices. They may contain various information. Their main purpose is to store user-related information during or after a visit to an online offering.

We may use both session cookies and persistent cookies. Users may disable cookies in their browser settings. However, disabling cookies may limit the functionality of the online offering.

Deletion of data

Data processed by us will be deleted or restricted according to Art. 17 and 18 GDPR. Unless otherwise stated, data is deleted when no longer required and no legal retention obligations exist.

Retention obligations in Germany and Austria remain unchanged (HGB, AO, BAO, etc.).

Collection of access data and log files

We or our hosting provider collect access data (server log files) based on legitimate interests (Art. 6(1)(f) GDPR). Log files are stored for up to 7 days.

Contact

When contacting us (via form, email, phone or social media), user data is processed to handle the inquiry (Art. 6(1)(b) GDPR). Inquiries may be stored in a CRM system.

Online presences in social media

We maintain social media presences. When interacting with us on these platforms, the terms and privacy policies of the respective operators apply.

Integration of third-party services and content

We use third-party content/services (e.g., videos, fonts) on the basis of legitimate interests (Art. 6(1)(f) GDPR). This requires transmission of users’ IP addresses. Providers may use pixel tags for analytics or marketing.
